Terms of Service & Refunds

Introduction

Welcome to Choobs. These Terms of Service (“Terms”) and Refund Policy govern your access to and use of our website at choobs.com.au (“Site”), and any purchases you make through the Site. By using the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Site or place an order.​

Definitions

  • “We”, “us”, “our”, or “Choobs” refers to the operator(s) of choobs.com.au.

  • “You” or “Customer” refers to the person accessing or using the Site or purchasing goods.

  • “Goods” or “Products” means the items for sale on the Site.

  • “Order” means your request to purchase Products via the Site.

  • “Site” means choobs.com.au and any associated subdomains.

Eligibility & Account

3.1 You must be at least 18 years old and able to form a binding contract under applicable laws to use the Site and place orders.
3.2 You may be required to create an account to place orders. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.3 You agree to provide accurate, current, and complete information when registering or placing an order, and to update such information as needed.

Orders & Acceptance

4.1 All orders are subject to availability and approval. We reserve the right to refuse or cancel any order for any reason (for example, errors in pricing or product information, payment issues, or stock unavailability).
4.2 If we cancel an order after you’ve been charged, we will issue a refund for the amount you paid (see Section 6).
4.3 You acknowledge that your order (including its price) is not confirmed until we send you a confirmation (for example, by email).

Pricing & Payments

5.1 All prices are in Australian Dollars (AUD), inclusive of GST (if applicable), unless otherwise indicated.
5.2 We reserve the right to modify prices at any time, though changes will not affect orders already accepted.
5.3 Payment must be made at the time of order via the payment methods offered on the Site.
5.4 You authorize us to charge your selected payment method for the purchase price and any applicable shipping or other fees.

Shipping & Delivery

6.1 We will ship the ordered Goods to the delivery address you specify.
6.2 Title to and risk in the Goods pass to you when the Goods are delivered to the delivery address you specify (or to our carrier).
6.3 We will use commercially reasonable efforts to deliver the Goods within the estimated delivery times. However, delivery times are estimates only and are not guaranteed.

Refunds, Returns & Exchanges

​7.1  If a Goods fail to meet a consumer guarantee, you are entitled to a remedy (including refund, repair or replacement)

7.1.2 Nothing in these Terms is intended to limit your rights.
 

7.2 Return Right & Refund Conditions

7.2.1 We accept returns and issue refunds under the following conditions:

  • You contact us within 14 calendar days of receiving the Goods to notify us of the return request and provide the reason (e.g. change of mind, wrong size, defect).

  • Goods must be returned in original condition, unused, with original packaging, tags, labels, and all accessories.

  • You must provide proof of purchase (e.g. order number, receipt).

  • You bear the cost of return shipping unless the return is due to our error (e.g. wrong item sent, defective item).

7.2.2 Once we receive and inspect the returned Goods, we will notify you whether the return is accepted or rejected. If accepted, we will process a refund within 7 business days to your original payment method (or another method if agreed).

7.2.3 If the return is rejected (e.g. Goods not in original condition, missing parts), we may refuse the refund and return the Goods to you (you may be responsible for shipping back to you).
 

7.3 Change of Mind / Wrong Size / Other Non-fault Returns

In case of “change of mind” returns (i.e. you simply changed your mind or ordered the wrong size), we may, at our discretion, accept or decline. If accepted, you pay for return shipping and any restocking cost we deem reasonable (which will be communicated to you before approving the return).
 

7.4 Defective or Incorrect Goods

If the Goods are defective, damaged in transit, or incorrect (i.e. not as described), contact us immediately (within 14 days) with photos and/or evidence. We will at our option either:

  • repair the Goods,

  • replace the Goods, or

  • refund the purchase price and return shipping costs.


7.5 Partial Refunds or Adjustments

In some cases (e.g. minor defect or damage), we may offer partial refunds or credit toward another purchase instead of a full refund.
 

7.6 No Refunds Policy for Certain Goods

Unless required by law (e.g. ACL), we do not accept returns or refunds for:

  • Goods that have been used or altered

  • Items purchased under a clearance or “as is” sale (unless defective)

  • Digital goods or downloadable content, once delivered

  • Items that are clearly of a perishable nature, or made to the customer’s specifications or personalised items

Cancellations

You may request to cancel your order before it has been dispatched. Once dispatched, cancellation may not be possible; instead, you will need to follow the Return/Refund procedure in Section 7.

Disputes & Liability

9.1 To the extent permitted by law, our liability for breach of these Terms or in tort is limited to the purchase price of the Goods.
9.2 We are not liable for any indirect, incidental, consequential, or special losses (lost profits, business interruption, etc.).
9.3 We do not guarantee that the Site will be error-free or uninterrupted.

Intellectual Property

All content on the Site (text, graphics, logos, images, product descriptions, software) is our property or licensed to us and protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, modify, distribute, republish, or display any materials from the Site without our prior written consent.

Privacy

Your use of personal information is governed by our Privacy Policy, which forms part of these Terms.

Modifications to Terms

We may revise or modify these Terms at any time. The updated Terms will be posted on the Site and will take effect when posted. Your continued use of the Site constitutes acceptance of the updated Terms.

Severability of Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. No waiver by us of any default or breach is a waiver of any subsequent default or breach.

Governing Law & Jurisdiction

These Terms are governed by the laws of Western Australia (or your state as applicable), and you submit to the non-exclusive jurisdiction of the courts of Western Australia (or your state) for any dispute.
